Overview
Dan Fisher-Owens focuses on U.S. export controls and economic sanctions. His practice covers transactional counseling, classification/commodity jurisdiction, licensing, designing and auditing compliance systems, as well as voluntary disclosures, investigations and enforcement matters.
While not an engineer, Dan enjoys digging into not just the legal complexities of export controls, but also the technical aspects of the products involved. Dan applies his experience as a translator (in his life before lawyering) to export controls, bridging communication gaps between those who “speak geek” and those who speak “Washingtonese.”
Representative Experience
- Advised U.S. and non-U.S. network technology companies on export control classification, licensing, and reporting relating to encryption items, AI processors and other microelectronic devices, quantum computers, semiconductor manufacturing equipment, and electronic test & measurement equipment.
- Assessed export control and sanctions risks and developed compliance policies, procedures, and compliance-related contractual clauses for cloud computing platform and software-as-a-service providers.
- Developed compliance programs and obtained export licenses for exporters of infrared and night vision devices.
- Provided export controls compliance support to U.S. manufacturers of military and dual-use unmanned aerial and marine systems.
- Analyzed commodity jurisdiction and classification for defense-related software products and obtained confirming government rulings.
- Represented technology companies in the preparation and resolution of voluntary disclosures related to unauthorized deemed exports and actual exports of source code and technology, resulting in warning letters.
- Assisted major pharmaceutical and medical device companies with sanctions and export control licensing for embargoed countries.
- Prepared successful petitions for remission of goods subject to outbound seizures by U.S. Customs for alleged export control violations.
- Counseled charitable organizations and foundations on economic sanctions and anti-money laundering compliance, including compliance program design.
