Overview

David Baron is an international lawyer with more than 30 years of experience representing governments, state-owned enterprises, private corporations and individuals in international litigation and arbitration proceedings before courts and international arbitral tribunals, including the International Court of Justice, the International Centre for the Settlement of Investment Disputes, international and domestic arbitrations, and federal district and appellate courts.

David is also an international sanctions lawyer who advises clients regarding all aspects of sanctions compliance, policy, enforcement and delisting. David’s clients often call on him to combine his sanctions knowledge with his litigation and arbitration experience in cases involving sanctioned parties, blocked funds, and/or questions as to whether entities or assets are blocked.

In 2020, David joined Berliner Corcoran & Rowe from a 25-year career in BigLaw to build and lead a team to bring cases under the Helms Burton Act on behalf of plaintiffs who had their property confiscated by the Castro Regime after it seized power in 1959. David and his team have helped bring a measure of financial justice to numerous Cuban-American families. These HBA cases enabled David and his team to combine David’s experience litigating claims over blocked property with his experience arbitrating boundary disputes and international expropriation claims with his sanctions experience and 30 years of experience in dealing with sovereigns such as Cuba.

Representative Experience

Helms Burton Act

  • Obtained beneficial settlements on behalf of numerous Cuban American families and Certified Claimants following litigation in federal district and appellate courts.  
  • Litigation of 10+ cases in numerous federal courts including the S.D.Fla., S.D.N.Y., D. Del., E.D. La., as well as the 5th and 11th Circuits, and the U.S. Supreme Court.
  • Negotiated settlements with some of the largest companies in the world represented by some of the largest law firms in the world.  

Expropriation Claims / International Centre for the Settlement of Investment Disputes

  • Lead Counsel in multiple cases before ICSID Investment Arbitral Tribunals on behalf of Claimant Investors and Respondent Sovereign States.
  • Defended West African State in numerous investment disputes arising out of disputes with oil and natural gas production companies, construction firms, and exploration projects.  
  • Represented Claimants in ICSID case against an Eastern European State over failed investment in medical sector.

International Litigation / International Commercial Arbitration

  • Lead Counsel in federal district and appellate courts representing plaintiffs and sovereigns in cases ranging from breach of contract disputes to an antitrust case.
  • Lead Counsel in arbitrations before the American Arbitration Association, International Chamber of Commerce, and Stockholm Chamber of Commerce.
  • Specialist sanctions counsel in litigations and arbitrations involving blocked assets, sanctioned parties and/or questions of the application of international sanctions.

Government Relations / Lobbying / Foreign Agents Registration Act

  • Provide advice and counsel regarding the Foreign Agents Registration Act and Lobbying Disclosure Act.
  • David has been a foreign agent/lobbyist on behalf of foreign governments and/or state-owned enterprises.
